Major Amendments to Michigan’s Marketable Record Title Act: What You Need to Know

On September 29, 2025, Governor Whitmer signed into law 2025 PA 13, which makes significant changes to the Marketable Record Title Act, 1945 PA 200 (“MRTA”), exempting a broad range of easements and restrictions from its operation and extends the deadline again for preserving certain property rights and interests under the MRTA. The deadline is now September 29, 2027. The deadline for preserving property rights and interests had been previously extended multiple times, giving holders of certain property interests an additional grace period for filing a notice of claim before the claim is extinguished. The most recent extension was last year’s passage of 2024 PA 20, which had extended the deadline to September 29, 2025, so 2025 PA 13 came just in the nick of time – a full three and a half hours before the clock ran out.
