Michigan Legislature Promotes Solar Energy Development With New Solar Energy Facilities Taxation Act

New legislation aimed at promoting solar energy development in Michigan went into effect on July 27, 2023. House Bill 4317 is tie-barred with 4318, the former creating the new Solar Energy Facilities Taxation Act (the “Act”), and the latter amending the General Property Taxation Act accordingly. The Act looks to galvanize support for solar development within local communities, while offering the benefit of more certain tax costs to developers via a fixed rate payment in lieu of taxes (PILT) framework in place of ad valorem property taxes. The combined effect of this two-pronged approach may reduce the level of contention and frequency of costly litigation between local governments and solar energy facility owners.
