Michigan’s New Clean Energy Siting Law Surges Ahead

Governor Gretchen Whitmer signed House Bill 5120 (PA 233 of 2023) into law on November 28, 2023. The law, which creates a new siting path for utility-scale wind, solar, and energy storage facilities with the Michigan Public Service Commission (“MPSC”), goes into effect on November 29, 2024. With the new law going live this fall, it is important that clean energy developers, municipalities, and the attorneys that service these clients become familiar with this new siting process. In addition to an overuse of energy puns in the headings, this article provides a high-level summary of the new MPSC certificate process and an update on the ongoing work being done by the MPSC and its staff to prepare for its implementation.
