Tenant exclusives, which have historically been a common feature of retail leases, are becoming increasingly common in today’s medical office leases. Exclusives were originally based on the assumption that shopping centers could not support more than one retailer for each category of merchandise. Since the 1990s, however, retailers have discovered the benefit of “synergy” and shopping centers have slowly moved away from exclusives, only to have them return in an unexpected field: healthcare.
