Land Division Act Update: PA 58 of 2025

In 2025 Public Act 58 (“PA 58”), the Legislature adopted, and the Governor approved, amendments to Section 108 of the Michigan Land Division Act. Adopted in 1997, the Land Division Act (“LDA”), formerly known as Subdivision Control Act, provides for the uniform and orderly partitioning of property and regulates the separation of real property into two or more smaller parcels. While some provisions of PA 58’s amendments to the LDA took effect on March 24, 2026, the amendments will have full effect on March 24, 2027. PA 58’s stated purpose is to “incentivize more construction of affordable housing depending on the local ordinance governing the build site.” Bill Analysis, Senate Fiscal Agency, 1/15/2026. Accordingly, Act 58 significantly increases the potential to create more parcels at a faster rate.

Real Property Law Academy II is the continuation of a new program being taught by some of the most respected and experienced Michigan real estate attorneys, each an expert in their field. The overall program (Academy I and Academy II) is designed to provide a basic understanding of the most fundamental aspects of a real estate practice.
