These natural instincts were molded through education and maturation, and the values of collaboration and partnership have become essential. The enactment of the Assisted Reproduction and Surrogacy Parentage Act (ARSPA) has rightly been celebrated for decriminalizing surrogacy in Michigan and establishing a comprehensive statutory framework for surrogacy agreements. Yet, the statute’s most transformative impact may lie in its lesser-known provisions governing parentage for children conceived through a broader array of assisted reproduction, including sperm donation and in vitro fertilization (IVF).

It is no secret that transgender rights have increasingly faced the ire of certain politicians in a concerted effort to restrict individual autonomy, bodily autonomy and liberty. This phenomenon is hypercharged by a media system that rewards fearmongering, making viewers more hostile toward their neighbors and eroding our humanity. The Trump Administration is playing out the idea of restricting gun ownership for transgender people and influential rightwing organizations are urging that all transgender people and their supporters be designated as terrorists.

In 2022, a draft Supreme Court opinion was leaked of Dobbs v. Jackson Women’s Health Organization, signaling the end of reproductive protections. 50 years of established precedent very quickly became a relic of the past, and the future of substantive due process became murky. Dobbs, in its peculiar opinion structure, rushed to overturn a right that people assigned female at birth had relied on for nearly half a century. But that was only the beginning.

Historically, Michigan considered the legal parents of a child to be one mother and one father. Not only is that clear through Michigan Compiled Law 551.1, a statute still on the books which defines marriage as “an inherently unique relationship between a man and a woman,” but also through the language of Public Act 305 of 1996.

I had just left a meeting with my externship advisor, where I asked for advice on applying to judicial externships. She told me, “your experience and diversity will be a strength on these applications.” Moments later, a new notification popped up from an unfamiliar sender.
