On February 21, 2023, the National Labor Relations Board (NLRB) in McLaren McComb, 372 NLRB No. 58, determined that an employer violated the National Labor Relations Act (NLRA) and an employee’s Section 7 rights by proffering a severance agreement with broad confidentiality and non-disparagement provisions. Our esteemed panelists will discuss the ramifications of the McLaren decision and the subsequent memo issued by the NLRB’s General Counsel on the workplace, especially given the current climate of heightened workplace activism.
