Michigan is now one of 17 states that has adopted domestic asset protection trust (DAPT) legislation, which allows individuals and entities to protect assets from creditors by placing them in a “self-settled trust” that complies with various statutory requirements. The legislation validates self-settled trusts that were previously held to be invalid against creditors under Michigan law. The DAPT legislation, along with changes made to the Michigan fraudulent transfer laws, were signed into law by Governor Snyder in December 2016, and became effective on March 8, 2017.
